General Terms and Conditions of Sale

GENERAL TERMS AND CONDITIONS OF SALE

The beaudoudou.com website is operated by the company BGRN GROUP, SAS, registered under SIREN number 992 503 375. Beaudoudou is the trading name of BGRN GROUP, SAS.

In accordance with Articles L.111-1 et seq. and L.221-1 et seq. of the French Consumer Code, as well as Articles 1127-1 et seq. of the French Civil Code, these General Terms and Conditions of Sale (hereinafter "GTC") govern all sales concluded between BGRN GROUP, operator of the beaudoudou.com website under the trading name Beaudoudou (hereinafter "Beaudoudou"), and any person making a purchase on this website (hereinafter "the Customer").

Any order placed on beaudoudou.com implies full and complete acceptance of these GTC, which the Customer acknowledges having read before confirming their order.

ARTICLE 1 – SELLER IDENTIFICATION

ARTICLE 2 – SCOPE

2.1 – Purpose
These GTC define the rights and obligations of the parties in the context of the distance sale of the products offered on beaudoudou.com (comforters, stuffed animals, nightlight stuffed animals, toys, swaddles, and baby accessories), intended for customers located in metropolitan France, Belgium, and Guadeloupe.

2.2 – Capacity
The Customer declares that they are at least 18 years old and have the legal capacity to enter into contracts. Our products are intended for children, but purchases must be made by an adult.

2.3 – Amendment of the GTC
Beaudoudou may amend these GTC at any time. The GTC applicable are those in force on the date of the order.

ARTICLE 3 – PRODUCTS

3.1 – Characteristics
The essential characteristics of each product (material, dimensions, recommended age, care and safety instructions) are presented on its product page, which the Customer is invited to consult before placing any order. The photographs are as accurate as possible; slight color variations may exist depending on screen settings.

3.2 – Compliance and safety
Our comforters and stuffed animals comply with European toy safety regulations and bear the CE marking. We recommend always using them under adult supervision and in accordance with the age indications.

3.3 – Availability
Offers are valid subject to available stock from our partners. In the event that a product becomes unavailable after an order is placed, Beaudoudou will inform the Customer as soon as possible and offer an equivalent product or a full refund of the amounts paid, no later than 7 days.

3.4 – Supply
Beaudoudou relies on a network of approved logistics partners, suppliers, and distributors located in Europe and internationally. Products are shipped directly from these partners' warehouses. Beaudoudou remains the Customer's sole point of contact and assumes full responsibility for the order, customer service, returns, and legal warranties.

ARTICLE 4 – PRICES

Prices are indicated in euros, all taxes included (TTC), including VAT at the rate in force on the date of the order. Standard delivery is free to all served destinations.

Beaudoudou may change its prices at any time; products are charged at the price displayed at the time the order is confirmed. Any customs duties, import taxes, and port duties are fully covered by Beaudoudou.

In the event of an obvious pricing error, Beaudoudou will inform the Customer, who may cancel their order and receive a full refund.

ARTICLE 5 – ORDER

5.1 – Process
The Customer selects their products, checks the contents of their cart and the total price, enters their delivery information, then confirms their order and proceeds to payment. Before final confirmation, they can review the details of their order and correct any errors.

5.2 – Confirmation
The order is final upon receipt of the confirmation email sent after payment confirmation, which summarizes the products, price, and terms of sale.

5.3 – Order Rejection
Beaudoudou may refuse or cancel an order in the event of suspected fraud, non-payment, or prior dispute, with a full refund where applicable.

5.4 – Cancellation Before Shipping
The Customer may cancel all or part of their order free of charge as long as it has not been shipped, by writing to contact@beaudoudou.com. The full refund will be issued within 7 days.

5.5 – Archiving
Beaudoudou archives orders and invoices on a reliable and durable medium, in accordance with Article L.213-1 of the French Consumer Code. The Customer may access them upon request.

ARTICLE 6 – PAYMENT

6.1 – Payment Methods
Payment is made online, in euros, in a single installment, by credit card: Visa, Mastercard, Carte Bleue (CB), American Express.

6.2 – Security
Payments are processed by our service providers Mollie and CAWL (Crédit Agricole – Worldline), compliant with the PCI-DSS standard, via an encrypted HTTPS connection and with 3D Secure strong authentication. No banking data is stored or viewed by Beaudoudou.

6.3 – Charging
The Customer's account is charged at the time the order is confirmed. In the event of payment refusal, the order is not confirmed and no amount is debited.

6.4 – Retention of Title
Products remain the property of BGRN GROUP until full payment of the price.

ARTICLE 7 – DELIVERY

7.1 – Served Areas
Delivery only to metropolitan France, Belgium, and Guadeloupe. Standard delivery is free, with no minimum purchase.

7.2 – Timelines

  • Preparation: 3 business days from order confirmation
  • Transit: 8 to 11 business days after shipping
  • Estimated total time: 11 to 14 business days

An email with a tracking number is sent upon shipping. In the event of a significant delay, Beaudoudou will inform the Customer. If delivery does not occur within the stated timeframe, the Customer may, after a formal notice remains unanswered, rescind the sale and obtain a full refund, in accordance with Article L.216-6 of the French Consumer Code.

7.3 – Address
The Customer is responsible for the accuracy of the delivery information. In the event of a delivery failure due to an incorrect or incomplete address, the returned package will be re-shipped or refunded; re-shipping fees may be charged.

7.4 – Receipt
The Customer reports any damaged package, missing product, or product not conforming to the carrier when possible, then to Beaudoudou within 30 days at contact@beaudoudou.com, with photos, without prejudice to legal warranties.

7.5 – Transfer of Risk
In accordance with Article L.216-4 of the French Consumer Code, risks are transferred to the Customer at the time they physically take possession of the package.

ARTICLE 8 – RIGHT OF WITHDRAWAL

8.1 – Timeframe
In accordance with Article L.221-18 of the French Consumer Code, the consumer Customer has a legal withdrawal period of 14 days from receipt to withdraw, without having to justify a reason. Beaudoudou extends this period to 30 calendar days from receipt.

8.2 – Exercise
The Customer notifies their decision by any clear statement to contact@beaudoudou.com, via the contact form, or by using the template below. Beaudoudou will send them a prepaid return label within 24 to 72 business hours. The product must be returned within 14 days of notification.

8.3 – Exclusions
In accordance with Article L.221-28 of the French Consumer Code, the following are excluded from the right of withdrawal, except in the event of a defect or non-conformity: hygiene articles or articles in contact with the mouth unsealed after delivery, as well as personalized articles or articles made according to the Customer's specifications.

8.4 – Refund
Returns are free. The refund of the full amount paid is issued within 7 days of receipt of the returned item, to the credit card used during the order. In the event of depreciation resulting from handling other than that necessary to check the product, the refund may be reduced proportionally (Article L.221-23).

8.5 – Withdrawal Form Template

ARTICLE 9 – LEGAL WARRANTIES

The Customer benefits, independently of any commercial warranty:

  • the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) for 2 years from the delivery of the item: they may obtain the repair or replacement of the item, or failing that, a price reduction or refund;
  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code) for 2 years from the discovery of the defect.

For any request, the Customer contacts Beaudoudou at contact@beaudoudou.com with their order number and photos. The return is free and the Customer obtains a replacement or full refund.

ARTICLE 10 – LIABILITY

Beaudoudou is legally responsible for the proper performance of the obligations resulting from the contract, in accordance with Article L.221-15 of the French Consumer Code. However, its liability cannot be engaged when non-performance or improper performance is attributable:

  • to the Customer, notably in the event of use of the products not in accordance with their intended purpose, safety instructions, or maintenance instructions;
  • to an unforeseeable and insurmountable act of a third party;
  • to an event of force majeure.

Nothing in these GTC limits the legal rights of the consumer Customer.

ARTICLE 11 – FORCE MAJEURE

No party shall be held responsible for a delay or non-performance resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (natural disasters, cyclones, epidemics, strikes, government decisions, logistics failures beyond its control). If performance becomes impossible, the order is refunded.

ARTICLE 12 – INTELLECTUAL PROPERTY

All content on the beaudoudou.com website (texts, images, logos, brand) is the property of BGRN GROUP or its partners. Any reproduction without prior written authorization is prohibited.

ARTICLE 13 – PERSONAL DATA

The Customer's data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, for the management of orders, delivery, and customer relations. It is never sold. The Customer has the right of access, rectification, erasure, objection, limitation, and portability, which they may exercise at contact@beaudoudou.com. ARTICLE 14 – COMPLAINTS AND MEDIATION

For any complaint, the Customer first contacts customer service at contact@beaudoudou.com or via the contact form. Beaudoudou responds within 24 to 72 business hours and seeks an amicable solution.

In the absence of agreement, in accordance with Articles L.612-1 et seq. of the French Consumer Code, the consumer Customer may free of charge resort to a consumer mediator.

ARTICLE 15 – APPLICABLE LAW AND JURISDICTION

These GTC are governed by French law. In the absence of an amicable resolution or mediation, any dispute will be brought before the competent French courts, in accordance with legal rules. Consumers residing in Belgium retain the benefit of the mandatory provisions of their national law.

ARTICLE 16 – MISCELLANEOUS PROVISIONS

If any clause of these GTC were declared null or inapplicable, the other clauses would retain their full validity.
